2. Rights of Data Subjects

You have the right:

  • pursuant to Art. 15 GDPR to request information about your personal data processed by us. If we process your data, you can in particular request information about the purposes of processing, the category of personal data, the categories of recipients to whom your data have been or will be disclosed, in particular recipients in third countries, the planned duration of storage or the criteria for determining this duration, the existence of a right to rectification, erasure, restriction of processing or objection, the existence of a right of complaint to a supervisory authority, the origin of your data, if they were not collected from us, as well as about the existence of automated decision-making, including profiling, and, if applicable, meaningful information about its details;

  • pursuant to Art. 16 GDPR, to request the immediate rectification of inaccurate or completion of your personal data stored with us;
 
  • request the deletion of your personal data stored with us, in accordance with Art. 17 GDPR, unless processing is necessary, in particular for exercising the right to freedom of expression and information, for compliance with a legal obligation, for reasons of public interest, or for the establishment, exercise or defense of legal claims;

  • request the restriction of the processing of your personal data pursuant to Art. 18 GDPR, provided that the accuracy of the data is disputed by you, the processing is unlawful but you refuse to have the data erased, and we no longer need the data, but you require it for the establishment, exercise, or defense of legal claims, or you have objected to the processing pursuant to Art. 21 GDPR and it has not yet been determined whether our legitimate grounds override your interests;

  • according to Art. 20 GDPR, to receive your personal data that you have provided to us in a structured, common and machine-readable format or to request the transfer to another controller, provided that the processing is based on your consent or a contract and the processing is carried out using automated procedures;

  • In accordance with Art. 7(3) GDPR, you can revoke the consent you have given us at any time. This will result in us no longer being allowed to continue processing the data based on this consent in the future and, in accordance with Art. 77 GDPR, to lodge a complaint with a supervisory authority. As a general rule, you can contact the supervisory authority at your usual place of residence or place of work, or at our registered office.

3. Right of Objection

If your personal data is processed on the basis of legitimate interests pursuant to Art. 6 (1) sentence 1 lit. e or f GDPR, you have the right, pursuant to Art. 21 GDPR, to object to the processing of your personal data, provided that there are grounds for doing so arising from your particular situation or the objection is directed against direct advertising. In the former case, we will no longer process your data unless we can demonstrate compelling legitimate grounds for processing which override your interests, freedoms and rights, or our processing is for the establishment, exercise or defence of legal claims. In the latter case, you have a general right to object, which will be implemented by us without requiring you to state a particular situation. 4. Data Transfer

Your personal data will not be transferred to third parties for purposes other than those listed below. We will only disclose your personal data to third parties if:

  • You have given your express consent pursuant to Art. 6(1)(1)(a) GDPR,

  • disclosure pursuant to Article 6(1) sentence 1 letter f GDPR is necessary for the establishment, exercise or defense of legal claims and there is no reason to believe that you have an overriding interest worthy of protection in the non-disclosure of your data,

  • in the event that there is a legal obligation for disclosure pursuant to Art. 6(1) sentence 1 lit. c GDPR, as well as

  • this is legally permissible and, pursuant to Art. 6 (1) sentence 1 lit. b GDPR, necessary for the processing of contractual relationships with you.

In addition, our contract processors will receive your personal data for processing according to our instructions, insofar as this is necessary for the fulfillment of the order. Our contract processors do not have their own right to use your data.

5. Data Security

We use the widespread SSL (Secure Sockets Layer) procedure during website visits, in conjunction with the highest encryption level currently supported by your browser. This is typically 256-bit encryption. If your browser does not support 256-bit encryption, we will use 128-bit v3 technology instead. You can tell if an individual page of our website is being transmitted in encrypted form by the closed representation of the key or lock icon, or by the use of https before the address of our (sub)website. We also employ appropriate technical and organizational security measures to protect your data against accidental or intentional manipulation, partial or complete loss, destruction, or unauthorized access by third parties. Our security measures are continuously improved in line with technological developments.

6. Third-party countries

We transmit data to third countries exclusively in accordance with legal regulations. The admissibility of data transmission to third countries is based on Art. 44 et seq. GDPR. If we transmit your data to a third country, you will be informed about this in the special data protection information for the respective processing process, stating the respective legal regulation.

Special Data Protection Information for Data Processing Processes on the Website

1. When visiting the website

When you visit our website, your browser automatically sends information to our website's server. This information is temporarily stored in a log file. The following information is collected without any action on your part and stored until automatically deleted:

  • IP address of the requesting computer,
  • Date and time of access,
  • Name and URL of the retrieved file,
  • Website from which access is made (referrer URL),
  • browser used and, if applicable, the operating system of your computer, as well as the name of your access provider.

 

The data mentioned will be processed by us for the following purposes:

  • Ensuring a smooth website connection setup,
  • Ensuring comfortable use of our website,
  • Evaluation of system security and stability, as well as
  • for further administrative purposes.
    The legal basis for data processing is Article 6(1)(f) of the GDPR. Our legitimate interest is in the operation of our website and the associated presentation of our company.

Your data will be deleted as soon as it is no longer needed for the stated purposes, and no later than 6 months.

2. When using our contact form

  • For questions of any kind, we offer you the option to contact us via a form provided on the website. You will need to provide a valid email address and your name so that we know who the request is from and can respond to it.

When filling out the contact form, we process the personal data you provide solely for the purpose of responding to your inquiry and/or for the initiation, establishment, amendment, and content arrangement of any contractual relationships, unless

  • unless you have been explicitly informed of further purposes and have consented to such use,

  • the processing is for a purpose that is directly related to the original purpose for which the personal data were collected,

  • processing is carried out due to a legal obligation or an official or judicial order, or

  • to establish or protect legal claims, or to defend against unlawful activities.

 

We will not sell, market, or otherwise share your personal data with third parties.

 

By submitting your message, you agree that we may process the data you provide for the purpose of processing your request and/or for the initiation, establishment, modification, and content design of any contractual relationships. Data processing for the purpose of contacting us takes place according to Art. 6 para. 1 sentence 1 lit. a GDPR based on your voluntarily given consent or for the initiation or fulfillment of contractual relationships according to Art. 6 para. 1 sentence 1 lit. b GDPR. The personal data collected by us for the use of the contact form will be automatically deleted after your request has been processed and will only be stored for the duration of statutory retention periods, if applicable.

3. When applying / using the application form

When you apply to us, you have the option to use the application form specifically set up for this purpose under the job advertisements. Alternatively, we are happy to continue accepting applications by email or the classic way on paper by post. In any case, your applicant data will be handled and processed by us according to the following principles.

Nölken places particular importance on ensuring the highest possible protection of your personal data. All personal data collected and processed in the course of an application with Nölken are protected against unauthorized access and manipulation by technical and organizational measures. We require your personal data in the application documents in order to consider you as an applicant in the application process and to check whether you are suitable as an employee of our company. If you provide information that goes beyond these required details, you are doing so voluntarily and agree to the processing of this information.

The legal basis for processing is therefore Article 6(1)(a) and (b) of the GDPR. Consent can be withdrawn at any time. You can send your withdrawal to HR@noelken.de by email at any time.

After completion of the application process, we will store your documents for an additional two months for evidentiary purposes.

For a possible conclusion of a contract, it is necessary for you to provide us with your personal data in your application documents. Otherwise, we cannot consider you in the application process.

4. Cookies, Analysis Tools, Plugins, and Other Third-Party Elements

We use cookies on our website. These are small files that your browser automatically creates and that are stored on your device (laptop, tablet, smartphone, etc.). Cookies do not cause any damage to your device and do not contain viruses, Trojans, or other malware. Information is stored in the cookie that relates to the specific device used. However, this does not mean that we immediately become aware of your identity. Google Analytics

For the purpose of needs-based design and continuous optimization of our websites, we use Google Analytics, a web analytics service provided by Google Ireland Limited (Gordon House, Barrow Street, Dublin 4, Ireland; hereinafter referred to as „Google“). In this context, pseudonymous usage profiles are created and cookies (see item 4) are used. The information generated by the cookie about your use of this website, such as

YouTube

We use YouTube LLC (901 Cherry Avenue, San Bruno, CA 94066, USA), a subsidiary of Google LLC (1600 Amphitheatre Parkway, Mountain View, CA 94043, USA) social plugins on our website to increase our company's visibility.

The plugins are marked with a YouTube logo, for example, in the form of a „YouTube camera“ or a „Play“ button.

We integrate these plug-ins using the so-called two-click method to best protect visitors to our website. This means that your personal data (especially your IP address) is not transmitted to YouTube when you visit our website. Instead, you must first activate the integrated „buttons“ and videos with a click. With this click, you give your consent for a connection to be established with YouTube's servers. You can revoke your consent by reloading the website.

Through this integration, YouTube receives the information that your browser has accessed the corresponding page of our website, even if you do not have a YouTube profile or are not currently logged into YouTube.

This information (including your IP address) is transmitted directly from your browser to a YouTube server in the USA and stored there. If you are logged into YouTube, YouTube can immediately associate your visit to our website with your YouTube account. If you interact with the plugins, for example by pressing the „YouTube“ button, this information will also be transmitted directly to a YouTube server and stored there. The information will also be published on your YouTube account and displayed there to your contacts.

If you do not want YouTube to immediately associate the data collected through our website with your YouTube account, you must log out of YouTube before activating the plugins.
